SUPPLY CONDITIONS:
Our obligation to deliver depends on the correct and timely supply of goods to us, except in cases where delays are caused by our negligence.
DELIVERY TIMES:
•
For standard deliveries, we commit to dispatching goods on or before the agreed date. Within Germany, deliveries typically occur within 72 hours and within 120 hours for other EU countries and Switzerland.•
Specific delivery deadlines or times ("fixed dates") require explicit agreement, subject to additional charges.•
Delays caused by the customer, such as incomplete delivery information, may result in additional charges for which the customer is liable.•
If the customer refuses to accept delivery or delays cooperation, Craftsman may claim compensation for resulting damages.DELIVERY AND RISK TRANSFER:
•
Under EXW terms, risk transfers to the customer once goods are made available at our warehouse.•
For CPT shipments, risk transfers to the customer when goods are handed over to the carrier. The customer is responsible for unloading and must ensure adequate equipment and personnel are available.•
If the customer is in default of acceptance, risk transfers regardless of whether the standard risk transfer has occurred.DEFECT NOTIFICATION:
•
Customers must inspect goods upon receipt and report visible transport damage immediately to the carrier and to us within one business day.•
Visible defects must be reported within 7 days of delivery, while hidden defects must be reported within 7 days of discovery but within the warranty period.•
Defect notifications must be documented with order and product details, accompanied by photos.ASSEMBLY AND SAFETY COMPLIANCE:
•
Goods are delivered unassembled unless otherwise agreed. Customers are responsible for site selection, compliance with legal safety standards, and proper assembly.•
Assembly instructions and safety guidelines (e.g., DGUV:108-007) will be provided with the delivery. These must be followed strictly.•
Any technical advice offered by Craftsman is binding only if confirmed in writing.•
Assembly services, if ordered, require a separate contract. Cancellations made less than 7 business days before the agreed date may incur cancellation fees of up to 100% of the service price.WARRANTY:
•
Warranty claims must be based on the condition of goods at the time of risk transfer. Post-transfer defects must be proven to have predated the transfer.•
Statutory provisions apply unless explicitly modified herein.i. Material Defects :
Normal wear and tear or improper use of goods does not constitute a material defect.
ii. Product Information and Deviations :

Product descriptions, such as illustrations, drawings, weights, dimensions, and performance data provided by Craftsman Storage Systems, are approximate averages based on standard practices and current technology. These do not guarantee specific qualities or suitability for particular purposes unless expressly agreed in writing.•
Industry-standard deviations, including for custom-made products, are permissible unless explicitly limited by agreement.iii. B-Grade Goods :
Goods labeled as B-grade are subject to a quality agreement. Any limitations or defects noted in the product description, visible in images, or typical of B-grade characteristics are not considered material defects.
iv. Warranty Exclusions :
No warranty applies if assembly, operation, or maintenance instructions are ignored, goods are modified, or non-original parts are used unless the customer proves the defect is unrelated.
v. Remedial Measures :
Craftsman Storage Systems may address defects by repair or replacement, with the customer allowing at least two attempts.
vi. Returns for Inspection :
Upon request, defective goods must be returned to Craftsman Storage Systems in secure, original, or equivalent packaging for inspection. Risk transfers to Craftsman Storage Systems upon receipt.
vii. Warranty Rights :
•
Craftsman Storage Systems may refuse warranty remedies under statutory provisions. Goods not returned as requested are exempt from warranty claims.
•
Customers may seek contract rescission or price reduction after a reasonable period for remedial action lapses unsuccessfully unless legally exempt.
•
Any damage or wear beyond normal use during rescission is the customer's liability.
•
Repairs or replacements do not restart the warranty period unless expressly acknowledged.
•
Claims for defects must be made within one year of delivery unless longer statutory periods apply
viii. Liability :
•
Craftsman Storage Systems is liable for damages caused by intent, gross negligence, fraudulent concealment, or guarantees provided.
•
In cases of gross negligence by agents or employees without breaching essential contractual obligations, liability is limited to foreseeable, typical damages.
•
Liability for ordinary negligence is restricted to breaches of fundamental contractual duties and limited to foreseeable damages.
•
Liability does not apply for damages arising from product misuse unless covered under the Product Liability Act or related laws.
•
Craftsman Storage Systems is not liable for indirect damages, and any liability limitations extend to employees and agents.
ix. Force Majeure :
Delivery times are extended during unforeseen events such as material shortages, labor disputes, pandemics, or other force majeure events. Both parties may withdraw if disruptions exceed two months.

x. COVID-19 Clause :
If delivery is disrupted by COVID-19-related events (e.g., lockdowns, quarantines), obligations are suspended during the disruption. If delays exceed two months, either party may withdraw.
xi. Retention of Title :
Goods remain Craftsman Storage Systems' property until full payment is received. In cases of resale, the customer assigns related claims to Craftsman Storage Systems. Processing or mixing goods transfers proportional ownership to Craftsman Storage Systems.
xii. Online Store Contracts :
Orders placed online are non-binding until explicitly accepted by Craftsman Storage Systems via invoice, shipping notification, or written confirmation. Payment options depend on the selected method at checkout, with delivery on account available after evaluation.
xiii. Final Provisions :
•
Invalid provisions do not affect the remainder of the contract.
•
Claims against Craftsman Storage Systems cannot be assigned to third parties without prior consent.
•
Jurisdiction for all disputes is Stuttgart, Germany.
•
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
